CITIZENSHIP ACT AND HUDOOD LAWS
DISCUSSED AT SHURA HAMDARD
Justice (R) Majida Rizvi, Chairperson, National Commission on Status of Women and former Judge of High Court of Sindh has said that the National Commission on the Status of Women at it earliest had recommended amendments in the citizenship Act which if a foreign female married a Pakistani national become entitled to apply for Pakistani citizenship but a male foreigner marrying a Pakistani women was not entitled to the same facility. However now with an amendment the children of such couple are entitled to apply for citizenship. But it was not enough and this discrimination in law must be ended.
She was addressing the meeting of Shura Hamdard Karachi chapter held under the chairmanship of Justice (R) Haziquel Khairi, Provincial Ombudsman Sindh on
Thursday July 10, 2003 on the topic "Women's role in reformation and reconstruction of society and social behaviors" at a local hotel.
Justice (r) Majida Rizvi further said that under the Pakistani constitution woman had been guaranteed of all her fundamental rights. Under article 25 equality before law and protection and no discrimination on the basis of sex alone. Under article 25 (3) state can make special provisions for the protection of woman and children and article 34 ensures as a policy of full participation of women in all spheres of national life. She said "We are signatory to LEDA and other Conventions and I will appeal to the Government of Pakistan to look into the recommendations sent by National Commission on the Status of Women for removing discriminatory clauses / pharoses from this law". These were sent to the Government Ministry of Foreign Affairs last year, she added. Honour Killing and KaroKari have no meaning in law except it was premeditated murder. Since Cr. P.C covered all types of murders the necessity was that Government as a policy should issue strict directives to the law enforcement agencies to lodge FIRs in all such cases, she emphasized.
She said the Hudood Laws the way they were drafted was very discriminatory. The National Commission on the Status of Women reviewed these laws and the report has been finalized to be passed by the Special Committee and the Commission. This would be done Inshallah by August 2003 positively. Under these laws the evidence of women has been completely excluded, which in my opinion is un-lslamic, she observed and said that it was a badly drafted faw and was being implemented in a society where every day young girls were being gang raped. First the society should be such where such laws could be
implemented
.
She said it was wrong to say that Islamic laws were being opposed. "I will strongly dispel this impression. It is the proper drafting and the correct interpretation of Islamic injunctions that every one is demanding "she said adding: for this consensus has to be build up by interaction with world Islamic scholars" She said the National Commission has arranged an international conference and is waiting for clearance from the government. She was critical of not being granted the status of federal minister to the chairperson of National Commission on the Status of Women while the Chairpersons of Commission for Higher Education and Human Resource Commission were granted status of federal minister and minister of state. It showed the in just behavior of society against women, she observed.
Mehtab Akbar Rashdi, Secretary Information, Ministry of Information, Government of Sindh speaking on the accession said that without participation of
women no society could make progress. If women did not work who would feed to those children who had no fathers. A rich women has no need to do job, a poor women does not care far anyone and would go for work early in the morning, it is the middle class women who bears the burden of social traditions. she said and asked who made these traditions it is the society only. She said that in every age of Muslim history worsen never remained inactive and took part in promoting the society. She said that Hadhrat Muhammad (peace be upon him) was the greatest benefactor of women: he got recognized women as a human being.
Lashing out at the custom of Karokari she said "it is not honor killing It Is a clear murder and a way of snatching of money and there is no disgustful act than this which is not a custom of Sindh".
Mrs. Sadia Rashid, President, Hamdard Foundation Pakistan, Shamim Kazmi a prominent social worker. Haq Nawaz Akhtar, Akhtar Begana, Anwaru! Haq Siddiqui. Syed Mustafa Ali Brelvi. Dr. Syed Amjad Ali Jaffery, Mohammed Said Siddiqui. Mrs. Mussarrat Akram and Professor Dr. Naeem Qureshi also spoke on the occasion.
Shura Hamdard In separate resolutions condoled the deaths of its members Tasweer Hussain Hameedi, Mukhtar Zaman and Chowdhry Abdul Ghafoor. Besides members, observers inalarge number attended the meeting.
